Please submit this information at your earliest convenience, space is limited! If we are able to offer you a place in the market, you will receive a confirmation from the Herb Society. 

The participation fee is $300 for a 10 x 10 foot space with a table and chair provided for you within a large, shared tent or $175 if you set up your own 10 x 10 tent and bring your own furnishings. 

Here are the terms and conditions that apply to your participation in the market:  

An invoice for the participation fee will be sent separately after this form is submitted and must be paid within two weeks of the invoice date. Late or non-receipt of payment may result in cancellation of your participation. Please note that the participation fee is non-refundable.

If the Herb Fair, or any part thereof, is cancelled for any reason or prevented from being held for any cause, the Herb Society of America shall determine and refund your appropriate share of the aggregate participation fee received which remains after deducting expenses incurred by the HSA. In no case shall the amount of refund exceed the amount of the participation fee paid.

You will load in and set up your area between 7:00 am and 9:30 am on Saturday, September 19. You will load out all products, display materials, etc between 4:00 pm and 5:00 pm that day (or September 20, if we use the rain date). If any of your property remains on site after 5:00 pm, it will be subject to disposal. 

Space will be assigned at the discretion of the Herb Society of America and Caramoor. You must contain your display, products, and other materials within your allotted space. You will make changes in your product display and on-site activities that Herb Society of America and Caramoor staff may ask you to make to eliminate any hazardous or unsafe conditions and to comply with Caramoor’s site rules. You will be responsible for maintaining your display area from set up to break down.  If you fail to make requested changes or to maintain your area, we may do this work ourselves, in which case we will not be responsible for any damage to your property. 

You will abide by all state and local requirements for sales tax that relate to your sales at the Herb Fair Market. You assume all responsibility for compliance with pertinent ordinances, regulations, and codes of local, state, and federal law and shall observe and abide by the rules established for the Herb Fair Market by Caramoor.

You will be solely responsible for theft or damage to your property, and for any damage you, your products or display may cause to others. The Herb Society does not maintain any insurance that covers you, your products, display materials, or any other property of yours while it is on site. 

Neither the Herb Society nor any of their officers, agents, employees, partners or other representatives shall be held accountable or liable for any damage, loss, harm, or injury to person or property resulting from theft, fire, water, accident or any other cause. You agree to indemnify, defend, and protect the Herb Society of America against, and hold harmless from, any and all claims, demands, suits, liability, damages, loss, costs, attorney fees, and expenses which might arise out of any action or failure to act by the Herb Society of America or any of their officers, agents, employees, partners and other representatives.

By signing this letter, you agree to the foregoing and further agree to defend, indemnify, and hold harmless Caramoor, and their officers, employees, and agents from and against any claims, damages, losses, and expenses arising out of or relating to this agreement

By signing this letter, you also grant the Herb Society of America and Caramoor the right to photograph, film and preserve in all media (including electronic or digital media) and present on our web site and social media channels images of you, your products and your display area taken during the Herb Fair, and to use and publish those images in any way, including for publicity purposes (including advertising). The Herb Society of America may also permit others to use the rights granted in this paragraph.
